This Privacy Notice explains how Hampton Court I & II and EKO Real Estate Management, Inc. (“we,” “us,” “our”) collect, use, and share information when you visit HamptonCourtNC.com (the “Site”), request information, submit an application, pay rent online, or communicate with us by SMS, email, phone, or through our online systems (including AppFolio).

1) Information We Collect
A. Information you provide

Leasing inquiries: name, email, phone number, desired move-in date, preferences, and message content

Applications: information you provide during the application process (for example, household details, address history, employment/income information, references, and other information needed to evaluate eligibility)

Resident account/portal information: details used to create and manage portal access and requests (for example, login credentials and messages)

Payments: information needed to process rent and other payments (see “Online Payments” below)

Communications: messages and information you provide via SMS, email, phone, webforms, and portals

B. Information collected automatically

When you use our Site or portals, we (and our service providers) may collect:

Device and usage data: IP address, browser/device type, pages viewed, timestamps, and referral/source information

Approximate location: generally derived from IP address

Cookies and similar technologies: see Section 4

C. Information from third parties

We may receive information from:

AppFolio (our property management/resident portal platform) in connection with inquiries, applications, portal use, and account administration

Screening providers used during the application process (where permitted by law)

Payment processing partners used to complete online transactions

2) How We Use Information

Respond to inquiries and provide leasing information

Process applications and determine eligibility

Provide and administer resident services and portal features (including maintenance/service requests)

Process rent payments and other charges

Communicate with applicants and residents via SMS, email, phone, and portal messaging

Improve Site functionality, usability, and service quality

Maintain security, prevent fraud, and enforce policies

Comply with legal obligations and respond to lawful requests

3) How We Share Information

We may share information with:

Service providers that help operate our business (for example: AppFolio, website hosting, analytics, email/SMS providers, call systems, screening providers, and payment processors)

Property ownership/management affiliates involved in operating the community

Professional advisors (legal, accounting, insurance) as needed

Government authorities or law enforcement when required or permitted by law

Business transfer parties in connection with a merger, acquisition, sale, or transfer of assets

Mobile information: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell personal information for money. If we use certain advertising/analytics tools, some privacy laws may treat certain disclosures as “sharing” for targeted advertising; choices related to cookies are described in Section 4.

You can opt out of marketing texts at any time by replying STOP (if supported) or by contacting us (Section 11).

Even if you opt out of marketing, we may still send service-related messages when needed (for example, application updates, payment/account notices, or maintenance coordination).

6) Applications and Screening

If you apply for housing, we and/or our vendors may collect and use information necessary to evaluate your application, which may include identity verification and other screening consistent with applicable law. Some parts of the process may be handled through AppFolio and other vendors that have their own privacy practices.

7) Online Payments

Online payments are typically processed through our payment/portal systems (including AppFolio and integrated payment processors). We generally do not store full payment card numbers on our own systems; payment details are processed by the payment processor under its security and privacy practices.

8) Data Retention

We keep information as long as reasonably necessary for:

Leasing and resident account administration

Payment processing and recordkeeping

Legal, regulatory, tax, and accounting obligations

Security, fraud prevention, and dispute resolution

Retention periods vary based on the type of information and applicable requirements.

9) Security

We use reasonable safeguards designed to protect information. No system is completely secure, and we cannot guarantee absolute security.

10) Children’s Privacy

Our website and services are not directed to children under 13, and we do not knowingly collect personal information from children.
